Overview and key points
This section explains the terms of use in plain language. For more details on the sale and use of this and other Products, please refer to the Store Policy.
You purchase this Semi-Custom Monogram in accordance with the Agreement on Terms and Conditions of Sale and Design Services (Store Policy). Once you have purchased the Semi-Custom Monogram, you and we become parties to this Agreement: you as the Client, we as the Designer.
The Designer grants the Client a one-seat, single-entity licence for the Semi-Custom Monogram. This licence is perpetual and worldwide. The Client selects the type of licence – non-exclusive or exclusive – within the Product before purchase, which determines the exclusivity of the rights granted.
Under the licence, the Client may use the Monogram provided with the Product as follows:
Permitted use:
- The Client’s Personal Use. Unlimited use in personal projects, events or occasions; as part of wedding branding or home décor; for customization of personal items or clothing; as a personal logo on social media, on the Internet and in printed materials; and as a hand-painted rendition on any object.
- The Client’s Business Use. Use as a business logo or as part of a corporate identity, online and on physical branding, in advertising and printed promotional materials, presented or distributed free of charge and not offered for sale.
- Use by the Client as a service provider or event organizer (e.g., a print shop, wedding planner, invitation designer, or other service vendor). Unlimited use for the requirements of a single customer of the Client within the scope of permitted Personal Use.
The Client may modify the Monogram within the scope of the permitted uses.
NOTE for the non-exclusive licence. The Monogram may be sold more than once and, therefore, may be used by more than one person or company.
NOTE for the exclusive licence. The Client or the customer of a service provider or event organizer is the sole user of the Monogram. The Monogram will not be licensed to any other person or company.
Prohibited use and restrictions
The Client must not:
- trademark the monogram
- use the Monogram as part of any product, merchandise, or item intended for sale or commercial distribution
- resell, sublicense, rent, or otherwise commercially distribute the Monogram
- make the Monogram available or transfer it for use by third parties, except for use by a single customer of a service provider or event organizer. A service provider or event organizer must not make the Monogram available for use by any customer other than the one it is purchased for
- use the Monogram to create derivative works for commercial sale or distribution
- use the Monogram in any manner that infringes copyright or other intellectual property rights, or in unlawful, offensive, or defamatory material
- use the Monogram without purchasing it
COPYRIGHT NOTICE
Any designs depicted in the Product images or elsewhere on the Product page are our copyright materials. Any unauthorized use of such designs, in whole or in part, including reproduction, whether in digital form or on physical items as well as hand-rendered reproductions or renditions, constitutes copyright infringement.
Any such action may result in legal action against you.
