Here we explain the terms of service in simple words. For more information about the terms of sale and service of this and other custom Products, please refer to the Store Policy.
You purchase and order this Product in accordance with the Agreement on Terms and Conditions of Sale and Design Services (Store Policy). Once you have purchased the Product, you and we become parties to this Agreement: you as the Client, we as the Designer.
Once the Designer delivers the design stipulated in the Product, the Client obtains property rights to the design, including rights to any original work of authorship created and embodied by the Designer in the Product. This means that the Client is the sole owner of the design.
The Client may use the design for personal and business purposes permitted by law. The Client may also trademark the design or part of it, use the design as part of a product intended for sale or commercial distribution. The Client may modify the design to suit the Client’s requirements.
The Client warrants and represents that the Client does not purchase the Design with the intention of reselling or sublicensing it for profit, and will not engage in such resale or sublicensing in the future. For the avoidance of doubt, the Client has the right, without additional Designer’s consent or Client’s fee, to sell, assign, license, or transfer the Design as part of a bona fide sale, merger, or change of control of the Client’s business, or solely for the purposes of the Client’s own business, including use by the Client’s subsidiaries, affiliates, or authorized vendors (e. g., manufacturers, printers, agencies, distributors, and affiliates).
The Client agrees that the Designer does not conduct any type of intellectual property clearance search (e.g., copyright, trademark, utility patent or design patent searches).
The Designer retains the right to participate in design contests, to publish, show, display, represent and reproduce the design as the author of works for self-promotional purposes in the Designer’s printed and online portfolios, including on levista.art, Behance and Pinterest platforms, TikTok and Instagram social media.
